FONDAZIONE ART. 49 cares about your privacy

Dear Data Subject, this Privacy Policy is being provided pursuant to art. 13 of European Regulation 2016/679 regarding the protection of individuals for what concerns “Processing of Personal Data” (GDPR) and art. 13 Privacy Code, related to data collected and processed to implement the event.

Pursuant to Article 13 of the GDPR the “Data Controller” is FONDAZIONE ARTICOLO 49 E.T.S. (hereinafter “FONDAZIONE”), with registered office in Via Rubens 19, 20148 Milan, VAT/Tax Code 12596200969.

The Data Processor of personal data is WITHUB S.P.A. with registered office in Via Rubens 19, 20148 Milan, VAT/Tax Code 10067080969, appointed by the Data Controller to ensure that processing takes place in accordance with applicable legislation. The Data Processor operates under the direct responsibility of the Data Controller and is committed to ensuring the security and confidentiality of data processed by implementing appropriate technical and organisational measures.

TYPE OF DATA PROCESSED

Registration for the Event takes place by filling in the appropriate “Form”; on sending it we collect the following personal information:

  • Name and surname/company name (mandatory)
  • E-mail address (mandatory)
  • Telephone number (optional)
  • IP address
  • Profession (optional)
  • Source of information about the event (mandatory)

These data are needed and useful to complete registration, since failure to provide that data or partial communication could prevent establishing relations with FONDAZIONE or provision by FONDAZIONE or its partners of the service required by the Data Subject.

Data processing purpose, legal basis, scope of communication and dissemination of data

Processing the data provided by submitting the Form is always based on our commitment to fulfil the registration you have requested, and on your express consent to receive and provide information related to our business, including related marketing and advertising activities, in order to offer you products or services of potential interest to you.

We collect and store the data provided by the person concerned when filling in the form for the following purposes:

  1. Register to take part in the Event;
  2. Answer enquiries submitted via the form, providing assistance and support services
  3. Proceed with subscription (subject to express consent);
  4. Send education, information and commercial communications (subject to express consent);
  5. Manage commercial profiling (subject to express consent).

If you refuse to communicate the data indicated as “mandatory” it may be impossible for FONDAZIONE to register you for the Event and provide the services required, and failure to provide the mandatory data will result in the form NOT being sent.

In cases where the data is indicated as “optional”, you are free not to communicate them, without this having any consequences on your registration for the Event and/or the provision of related and requested services.

By sending the data entered in the Form to FONDAZIONE you take responsibility for the personal data communicated and guarantee that you have the right to communicate or circulate them, releasing FONDAZIONE from any liability towards third parties.

At the end of the Form filling-in procedure and before sending it, you will always be asked for your explicit consent to it being processed, which is optional concerning the main service you request (registration for the Event), but indispensable in order to give you access to further services and send you communications, information and promotional initiatives of your interest.

Declaring awareness of this notice by ticking the appropriate box is optional, but indispensable in order to send the Form.

COMMUNICATION AND DISCLOSURE OF DATA

Within the limits pertinent to the processing purposes indicated, your data may be communicated to partners, consultancy companies, private companies, appointed as Data Processors by the Data Controller. The Data Processors and Persons in Charge of Processing in office are punctually identified in the Privacy Document, which is updated periodically.

Your data will not be disseminated in any way.

TRANSFER OF DATA ABROAD
Data collected will not be transferred outside EU countries.

STORAGE PERIOD

The data collected will be stored for a period of time not exceeding the achievement of the purposes for which they are processed and, in any case, not exceeding the period provided for by tax and civil law regulations corresponding to 10 years (“principle of limitation of storage”, art.5, GDPR) or according to the deadlines provided for by law.

Data collected for purposes attributable to the legitimate interest of FONDAZIONE shall be retained until that interest has been satisfied.

A check on the obsolescence of the retained data in relation to the purposes for which they were collected is carried out periodically.

DATA PROCESSING METHODS

The personal data you provide will be processed in compliance with the aforementioned legislation and with the confidentiality obligations that govern the Data Controller’s activities.

The data will be processed both by computer and on paper or any other suitable type of support, in compliance with the appropriate technical and organisational security measures provided for by the GDPR.

RIGHTS OF THE DATA SUBJECT

With reference to data communicated to FONDAZIONE through the Form, you always have:

  • the right to obtain information about the processing we perform (right of access to data), to request the rectification and deletion of data, and to obtain communication thereof to the third parties to whom we have sent them;
  • the right to be forgotten;
  • the right to restrict the processing of your data;
  • the right to data portability.

OBJECTION TO PROCESSING AND COMPLAINT

Remember that you ALWAYS have:

  • the right to file a complaint with a supervisory authority;

According to the provision in Article 21 GDPR:

1) motivating your request on grounds relating to your particular situation, you have the right, at any time, to object to the processing of personal data concerning you, including profiling, when the processing is carried out in accordance with Article 6(1)(e) or (f) and thus when the processing

  1. a) is needed to perform a task carried out in the public interest or to exercise the official authority held by the controller.
  2. b) it is needed for pursuit of the legitimate interests of the data controller or of third parties, provided that your interests, or your fundamental rights and freedoms, which require the protection of your personal data, in particular if you are a minor, are not overridden.

2) without having to provide a reason, you always have the right to object at any time to the processing of personal data concerning you that is carried out for direct marketing purposes, including profiling in connection with direct marketing;
